The Rules Governing for Use of Services

HASKART TERMS OF SERVICE

v1.1 — Updated April 2026

1. Introduction

These Terms of Service (“Terms”) govern your use of the Haskart platform (“Platform”). By accessing or using Haskart, you (“User”, “You”) agree to these Terms. If you do not agree, you must stop using the Platform.

Haskart may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.

2. Platform Overview

Haskart is a lifestyle and nonclinical wellness platform offering:

  • Pitstop+: A discovery hub for food, shops, scenic escapes, and wellness content.
  • Haskart Wellness: Booking and access to virtual wellness sessions (yoga, massage, nutrition guidance, clinical consultations).
  • Privacy & Compliance: PDPA-aligned privacy frameworks ensuring secure data handling and Zoom-powered consultations.
  • Service Provider Tools: Listing, discovery, booking, scheduling, secure communication, and payment processing.

3. User Eligibility

To use the Platform, you must:

  • Be at least 18 years old
  • Provide accurate information
  • Have legal capacity to enter agreements
  • Not be restricted under Malaysian law

Haskart may suspend or reject accounts that do not meet eligibility requirements.

4. Account Registration & Security

Users and Service Providers must:

  • Provide accurate information
  • Keep your login credentials secure
  • Be responsible for all activity under your account
  • Notify Haskart of unauthorized access

Haskart may suspend accounts for misuse or security concerns.

5.Community & Content Guidelines

These rules apply to all members (Users, Contributors, Wellness Centres).

5.1 Respect & Safety

  • Treat others with kindness and professionalism
  • No harassment, bullying, threats, or intimidation
  • No hate speech, discrimination, or abusive behaviour
  • No illegal content, scams, fraud, or impersonation

5.2 Privacy

  • Do not share personal information without consent
  • Do not post NRIC, phone numbers, addresses, or private conversations
  • Respect boundaries during virtual and in-person interactions

5.3 Pitstop+ Posting Rules

  • Allowed: scenic locations, travel experiences, merchant tags, personal reflections, YouTube
  • links aligned with Haskart categories.
  • Not allowed: graphic/violent/sexual content, misleading clips, fake reviews, sensitive personal data, hate speech.
  • Interaction rules: use Like, Share, Flag responsibly; report harmful content properly.
  • Moderation: Haskart may remove violating content; repeated violations may result in suspension.

6. Service Provider Agreement

This applies to all individuals and businesses offering services through Haskart.

6.1 Eligibility & Onboarding

  • Manual verification required before activation
  • Individual Contributors: identity documents, background, service descriptions
  • Wellness Centres: business registration, service menu, staff qualifications, operating hours

6.2 Scope of Services

Permitted: virtual wellness sessions, in-person services (massage, spa, beauty, coaching, licensed clinical consultations).

Prohibited: medical/clinical services without license, misrepresentation of qualifications, offplatform bookings or payments.

6.3 Responsibilities

  • Honour confirmed bookings
  • Start sessions on time
  • Maintain safe, respectful environment
  • Keep availability updated
  • Notify Haskart of cancellations or changes
  • Respect User boundaries
  • Maintain hygiene and safety standards
  • Keep User data confidential (PDPA compliance)

6.4 Payments

  • All payments processed through Haskart
  • Commissions deducted before pay-out
  • Balance transferred to Service Providers on the 15th of each month
  • No off-platform payments or solicitation

6.5 Content & Marketing

  • Upload accurate service descriptions
  • Use real photos of centres/services
  • Avoid misleading claims

7.Booking, Payments & Refunds

7.1 Booking Confirmation

A booking is confirmed when:

  • Service and time slot selected
  • Payment completed
  • Confirmation notification issued

7.2 Cancellation Rules

  • Virtual Sessions: free cancellation ≥ 6 hours
  • In-Person Sessions: free cancellation ≥ 3 hours
  • No-shows: non-refundable

7.3 Refunds

Refunds issued when:

  • Service Provider cancels
  • User cancels within allowed window
  • Verified technical issues occur

No refunds for: no-shows, late cancellations, dissatisfaction with service outcome, offplatform arrangements.

8. Data Protection

  • Compliance with PDPA and Haskart Privacy Policy
  • No storage or sharing of User data outside Platform (except as required by law)
  • Immediate reporting of data breaches

9. Prohibited Conduct

You must not:

  • Use Platform for illegal activities
  • Harass, defame, or mislead others
  • Upload harmful code
  • Scrape or harvest data
  • Circumvent payments

10. Enforcement & Consequences

Haskart may:

  • Remove content
  • Suspend accounts
  • Terminate accounts permanently
  • Report violations to authorities

Haskart’s decisions are final.

11. Disclaimers & Liability

  • Platform provided “as is”
  • Haskart does not guarantee service quality or outcomes
  • Independent Service Providers are fully responsible for services
  • Haskart is not liable for disputes between Users and Service Providers

13. Governing Law

These Terms are governed by Malaysian law. Disputes will be resolved in Malaysian courts.
